Project Title: Private Law Relations in Disputes Containing a Foreign Element
Project Description
This project examines private law relationships arising on disputes that involves a foreign element, focusing on the legal complexities created when parties, transactions, or legal facts are connected to more than one jurisdiction. In an increasingly globalized world, cross-border interactions in areas such as contracts, family law, inheritance, property, and commercial transactions frequently give rise to conflicts of laws.
The study analyzes the core principles of private international law, including jurisdiction, applicable law, and the recognition and enforcement of foreign judgments. It explores how courts determine the competent forum, which national law governs the dispute, and under what conditions foreign decisions are recognized or enforced domestically. Particular discussion is given to party autonomy, public policy limitations, and the protection of fundamental rights in cross-border legal relationships.
About the Project
Through international law analysis and selected case studies, the project evaluates the effectiveness of existing legal frameworks and identifies challenges posed by globalization, migration, and international commerce.
Project Objectives
The research aims to contribute to a clearer understanding of how private law systems address disputes containing a foreign element and to propose recommendations for improving legal certainty, predictability, and fairness in transnational private law relations.
Project Tasks
Analyze the principles of jurisdiction and determination of the applicable law in disputes containing a foreign element, examine the conditions for recognition and enforcement of foreign court judgments, conduct case studies to evaluate how private law relations are resolved in cross-border disputes.
